WebSketch respects the rights of copyright holders and expects its users to do the same. Under the Digital Millennium Copyright Act (17 U.S.C. § 512), we respond to valid notices of claimed infringement and remove or disable access to the material they identify.
Sending a notice of infringement
If you believe content on WebSketch infringes your copyright, send a written notice to our designated agent. A valid notice must include all of the following:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim is infringed.
- Identification of the material you claim is infringing, with enough detail for us to find it. Give the page address, such as a
/sketch/…, /view/…, or /u/… link.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act for the owner.
We may not act on a notice that is missing one of these. We may ask you for what is missing.
Designated agent
- Name: [TO BE COMPLETED: designated agent, once registered]
- Address: [TO BE COMPLETED]
- Email: [TO BE COMPLETED: a dedicated address is recommended]
Do not send false claims. Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing can be liable for damages.
What happens next
When we receive a valid notice, we promptly remove or disable access to the material. We tell the user who posted it, and we pass on the notice. We may redact the sender's contact details. We keep a record of the notice. We may also keep a copy of the removed material while the matter is open, and for as long as the law requires.
Counter-notice
If you posted material that was removed and you believe it was removed by mistake or misidentification, you can send a counter-notice to the designated agent. A counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, outside the US, any judicial district where WebSketch can be found), and that you will accept service of process from the person who sent the original notice.
We forward a valid counter-notice to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they have filed a court action, we may restore the material.
Repeat infringers
We terminate the accounts of users who are repeat infringers in appropriate circumstances. A user whose content is removed after valid notices more than once may be banned. Termination follows the Terms of Service.
Other illegal content
This page is for copyright claims. To report other content that breaks the law or our Terms, use the Report option on a sketch or profile, or the support page.
