Introduction
Welcome to WebSketch! These terms and conditions outline the rules and regulations for the use of WebSketch's website, located at websketch.dev.
Acceptance of Terms
By creating an account, ticking the box that says you agree, or otherwise using WebSketch, you agree to these terms and to our Privacy Policy. If you do not agree, do not use WebSketch. We record the version of these documents you accepted when you finish setting up your account.
Modifications to Terms
We may revise these terms. We will post the new version here with a new date. For a material change, we will also give notice in the app or by email, normally at least 14 days before it takes effect, unless the change is needed sooner for legal or security reasons. If you keep using WebSketch after a change takes effect, you accept the new terms. If you do not agree, stop using WebSketch and tell us if you want your account deleted.
Use of the Site
By accessing this website, you agree to use it only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website.
User Accounts
To access certain features of the site, you may need to create an account. You agree to:
- Provide accurate, current, and complete information during the registration process
- Update such information to keep it accurate, current, and complete
- Maintain the security of your account credentials
- Be fully responsible for all activities that occur under your account
Eligibility and age
You must be at least 13 years old to use WebSketch, and we ask for your birth month and year when you set up your account. We keep an age range, not your birth date. If you are 13 or older but under the age of majority where you live (18 in most places), you may use WebSketch only with a parent or guardian's permission, and they agree to these terms for you. If the law where you live sets a higher minimum age for online services, you must meet it. We may suspend or delete an account if we learn the person is under 13, or is below the minimum age that applies to them.
User Content
You are solely responsible for the content you upload, post, or otherwise make available through WebSketch, including sketches, code, images, titles, descriptions, tags, usernames, profile text, and AI prompts. You agree not to upload, post, or transmit any content that is:
- Illegal
- Harmful
- Threatening, harassing, or abusive
- Defamatory or obscene
- Sexually explicit content involving minors, or sexual content in any public space
- Hateful toward people because of who they are
- Real-world instructions for violence, weapons, or self-harm
- In violation of any third party's rights, including copyright
You also agree not to use the AI features to generate any of the above, or to try to get around the checks described below.
Content Monitoring and Enforcement
WebSketch checks content to keep the service safe. We may check AI prompts before they are sent to our AI provider, check text you publish (such as titles, descriptions, tags, and profile fields), check images you upload, and check rendered previews of public sketches. Some checks are automated. A request or a piece of content that fails a check may be blocked, hidden, or removed. Flagged AI prompts are kept for up to 30 days so we can review appeals, as described in the Privacy Policy. Other people can report content, and we review those reports.
We may remove or hide content that violates these Terms or is otherwise deemed harmful or illegal. Sketches that are hidden stay available to their owner. Enforcement for repeated or serious violations escalates as follows:
- Restriction. Your account is placed in a time-limited restriction, starting at 24 hours and increasing to 7 days and then 30 days for repeat violations. While restricted, you can sign in, view WebSketch, and edit your own sketches privately. You cannot publish, invite or collaborate, report content, change your username or profile, or (when the restriction was caused by AI prompts) use AI generation. Your public sketches are hidden until the restriction ends. We show you a notice with the end time. You can contact us through the support page to ask us to review it. A restriction lifts automatically when it ends, or earlier if we lift it.
- Termination. We may suspend or permanently terminate your account for serious violations (for example, sexual content involving minors), for repeated violations, or for abuse of the service, including fraud. When we do, your sign-in is disabled and your public content is removed from public view.
Where the law requires it, we remove and report illegal content to the relevant authorities, and we may keep copies of that content as evidence.
AI Features
WebSketch can generate code and other content from your prompts using third-party AI models. AI output can be wrong, incomplete, insecure, or similar to other output, and it is not reviewed by us before you see it. You are responsible for reviewing it and for how you use it, including any sketch you publish. Do not rely on AI output for medical, legal, financial, safety-critical or similar decisions. As between you and WebSketch, and to the extent the law allows, you own the output you generate, subject to the rights of others and to the licenses of any open-source material it contains. Usage limits and the other terms of the AI features are described elsewhere in these terms and in the Privacy Policy.
Third-Party Services and Links
WebSketch uses and links to services we do not run, such as authentication, hosting, AI, payment and analytics providers, and content hosted or imported by users. Their terms and privacy practices apply to your use of them, and we are not responsible for them.
Reporting Illegal Content
If you encounter any content that violates the law or our Terms, please report it immediately. WebSketch takes illegal content seriously and will take appropriate action, including removing such content and reporting it to the relevant authorities.
Free Beta and Supporter Subscription
WebSketch is in beta. Using it, including AI generation, is free within usage limits. Limits apply per day for visitors who are not signed in, and per five-hour session and per week for signed-in accounts. We show how much of each limit remains and when it resets. Signed-in AI use requires a finished profile setup and a confirmed email or sign-in identity. We may pause AI features at any time to control cost or stop abuse.
There is an optional paid supporter subscription. It is processed by Stripe, and WebSketch does not store your card details.
WebSketch is in beta. The supporter subscription is a way to support development while things settle. It currently includes higher usage limits (about 5× the free limits) and early access to new features. Limits, features and price may change and are not guaranteed. Cancel anytime; cancellation takes effect at the end of the current billing period.
- Price and renewal. The supporter subscription costs $5 per month (USD) and renews automatically each month until you cancel. Taxes may be added where required.
- Cancel anytime. You can cancel at any time in the Stripe Customer Portal, linked from Account → Usage. You keep supporter access until the end of the billing period you already paid for. Then it ends and does not renew.
- Changes. Usage limits, included features and the price may change at any time, and none of them are guaranteed. We will give advance notice of a material cut to supporter limits or a price increase, so you can cancel first. The subscription does not promise unlimited use, a fixed number of generations, or any feature date.
- Eligibility. The subscription is offered only in the countries we currently support, and the list can change. If a subscription is started from a place we do not support, we refund it and cancel it.
- Payment processing. Payments are processed by Stripe. Depending on your location, your purchase may be sold through Stripe's Link as merchant of record, under its terms. In that case Stripe may also issue refunds under its own policies.
- Restriction. A restriction blocks AI generation for everyone, supporters included, until it ends. Your subscription is not paused and keeps billing unless you cancel it. See our Refund Policy for the cases where we refund.
- Termination. If we terminate your account for a violation of these Terms, your supporter status ends, we cancel the subscription, and we refund the current billing period as described in our Refund Policy.
- Refunds. Refunds are governed by our Refund Policy.
- Fraud and disputes. If a payment was made without the cardholder's permission, we may refund it and end the subscription. Please contact us before filing a chargeback so we can help.
- Your rights. Nothing here limits any refund or cancellation right you have under the law where you live.
Intellectual Property
You retain any rights you have in the sketches and other content you create. By uploading or publishing content, you give WebSketch permission to host, process, display, and share it as needed to operate the features you choose. You are responsible for having the rights needed to submit your content. WebSketch's name, branding, and software remain with their respective owners. Public content belongs to its creator or other rights holder, not automatically to WebSketch.
If you believe content on WebSketch infringes your copyright, see our copyright (DMCA) policy.
Termination
You can stop using WebSketch at any time. We may suspend or terminate your access to the website, with or without notice, for a breach of these Terms or for any other reason allowed by law, as described under Content Monitoring and Enforcement above. If we terminate your account for a violation, the Free Beta and Supporter Subscription terms above apply. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and governing law) will survive.
Disclaimers
WebSketch is a beta service. The service and everything on it are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not promise that your sketches, files or other content will always be available or free of loss, so keep your own copies of anything important. Some places do not allow certain disclaimers, so some of this may not apply to you.
Limitation of Liability
To the fullest extent the law allows, WebSketch and its creator will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to your use of WebSketch, even if we were told they were possible. To the fullest extent the law allows, our total liability for all claims relating to WebSketch will not exceed the greater of (a) the amount you paid WebSketch in the 12 months before the event that gave rise to the claim, and (b) US $100. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or limits any consumer right that cannot lawfully be waived where you live.
Indemnification
To the extent the law allows, you agree to defend and indemnify WebSketch and its creator against claims, damages and reasonable costs arising from content you submit, your use of WebSketch in violation of these terms, or your violation of another person's rights. We will tell you about a claim we want your help with, and you may not settle a claim in a way that binds us without our consent.
Governing Law and Disputes
These terms are governed by the laws of the State of [STATE: TO BE COMPLETED] and applicable United States federal law, without regard to conflict-of-law rules, and subject to any consumer-protection law of your home country that cannot be waived. If you have a dispute with us, please first contact us at the email below and give us 30 days to try to resolve it informally. If that fails, the courts located in [COUNTY, STATE: TO BE COMPLETED] have jurisdiction, except that you may also bring a claim in small-claims court in your home area, or where the law gives you the right to sue in your home country. Nothing in these terms removes consumer rights that cannot lawfully be waived where you live.
General
These terms, together with the Privacy Policy, Refund Policy and Copyright (DMCA) Policy, are the whole agreement between you and WebSketch about the service. If a part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a sale or transfer of the project. WebSketch is operated from the United States and is not offered where the law prohibits it; you may not use it if you are subject to US sanctions or export restrictions. A notice to you may be given by email, in the app, or by posting it on this page.
Accessibility
We work to make WebSketch usable by everyone. See our Accessibility Statement, or tell us about a barrier using the contact details below.
